1. ONLINE STORE TERMS
By using our website or placing an order, you represent that you are legally permitted to enter into a binding transaction under the laws applicable to you or that you are using the website with the permission and supervision required by applicable law.
You may not use our products, website, or services for any unlawful or unauthorized purpose.
You may not violate any applicable laws or regulations while using our website or services.
Any violation of these Terms may result in the suspension or termination of access to our services, subject to applicable law.
2. PRODUCTS & SERVICES
Jophiel Co. & The Modern Rancher offer products that may include apparel, embroidered garments, hats, jewelry, handbags, accessories, personalized products, laser-engraved items, DTF-decorated products, custom-made items, and other merchandise.
Certain products may be available exclusively online, in limited quantities, through pop-up events, or for limited periods.
We reserve the right to modify, discontinue, limit, or update products or services at any time, subject to applicable law and any obligations relating to orders already accepted.
Product availability is not guaranteed.
3. PRODUCT IMAGES, COLORS & DESCRIPTIONS
We make reasonable efforts to display our products, colors, materials, dimensions, embroidery, engraving, textures, and details as accurately as possible.
However, actual colors and appearance may vary depending on:
• Screen or device settings
• Lighting and photography
• Material or fabric variations
• Manufacturing differences
• Natural characteristics of materials
• Handmade or customized processes
Slight variations that are inherent to handmade, embroidered, engraved, customized, or natural-material products may occur and do not necessarily constitute a defect.
We strive to keep product descriptions and photographs accurate. If a material error is discovered in a product listing or order, we reserve the right to correct it and, when appropriate, contact the customer regarding any affected order.
4. PERSONALIZED & CUSTOM PRODUCTS
Many of our products may be personalized, embroidered, engraved, printed, decorated, or otherwise customized specifically for the customer.
Customers are responsible for carefully reviewing all customization information before submitting an order, including:
• Names
• Initials
• Dates
• Spelling
• Wording
• Sizes
• Colors
• Fonts or design selections
• Placement choices
• Other personalization details
We generally produce personalized products according to the information submitted or approved by the customer.
Once customization or production has begun, cancellations, modifications, returns, or exchanges may not be possible.
Personalized and custom-made items are generally FINAL SALE, except where an item has a verified defect, was incorrectly produced due to an error on our part, or where otherwise required by applicable law.

5. CUSTOMIZATION VARIATIONS
Because embroidery, engraving, printing, hat customization, and other personalized processes may involve individual production, slight variations in placement, spacing, color, texture, stitching, engraving appearance, or finish may occur.
These minor variations are part of the nature of customized products and do not necessarily constitute defects.
Nothing in this section limits your rights regarding products that are materially defective, incorrectly produced, or otherwise subject to remedies under applicable law.
6. PRICES
All prices are displayed in the currency indicated on our website and may be changed without notice.
A price change will not ordinarily affect an order already accepted and paid for, except where permitted or required by applicable law, including circumstances involving an obvious pricing or technical error.
Applicable taxes, shipping charges, customization fees, and other disclosed charges may be added during checkout.
We reserve the right to correct pricing, typographical, or listing errors.
If an error materially affects an order already placed, we may contact you with available options, which may include correcting the order or canceling and refunding the affected transaction as appropriate.
7. ORDERS
Submitting an order does not necessarily guarantee acceptance.
We reserve the right, where reasonably necessary and permitted by law, to refuse, limit, or cancel an order, including in cases involving:
• Suspected fraud or unauthorized transactions
• Incorrect pricing or product information
• Inventory errors
• Payment verification issues
• Shipping restrictions
• Suspected resale or misuse
• Technical errors
• Inability to fulfill a customization request
If we cancel an order after payment has been successfully processed and no product is provided, the applicable amount paid for the canceled portion will be refunded as required.

8. ACCURACY OF CUSTOMER INFORMATION
You agree to provide current, complete, and accurate information when placing an order.
This includes accurate:

• Billing information
• Shipping address

• Customization instructions
You are responsible for reviewing your information before submitting your order.

We will make reasonable efforts to assist, but changes cannot be guaranteed after processing, customization, fulfillment, or shipment has begun.
9. PAYMENTS
Payment must be successfully authorized before an order can be processed.
Payment processing may be provided by Shopify and/or third-party payment providers. Your use of those payment methods may also be subject to the applicable provider’s terms and privacy practices.
We do not guarantee that every payment method will always be available.
Orders suspected of fraud, unauthorized activity, or payment irregularities may be delayed, reviewed, declined, or canceled as permitted by law.
10. SHIPPING & DELIVERY
Processing and delivery estimates are provided as estimates and are not guaranteed unless expressly stated otherwise.
Delivery times may be affected by circumstances outside our reasonable control, including:
• Carrier delays
• Weather
• Holidays
• High order volume
• Customs or governmental processing
• Incorrect or incomplete addresses
• Supply or production delays
Customers are responsible for providing a complete and accurate shipping address.
Once an order has shipped, carrier tracking information, when available, should be used to monitor delivery.
Any rights or remedies concerning lost, damaged, delayed, or misdelivered packages remain subject to applicable law and our posted Shipping Policy.
11. RETURNS, STORE CREDIT & FINAL SALE ITEMS
Our Return & Refund Policy is incorporated into these Terms.
Unless otherwise stated or required by applicable law:
• Eligible returns must be requested within 20 days of delivery.
• Approved voluntary returns are issued as STORE CREDIT in accordance with our Return & Refund Policy.
• Customers are responsible for return shipping costs for eligible voluntary returns involving size, fit, preference, color, style, or change of mind.
• When we provide a prepaid return label for an eligible voluntary return, the disclosed cost of that label may be deducted from the store credit issued.
• Original shipping charges are generally non-refundable for voluntary returns.
• Personalized, customized, embroidered-to-order, engraved, laser-personalized, made-to-order, and other specially customized products are generally FINAL SALE.
Different remedies may apply when an item is incorrect, damaged, materially defective, or affected by an error attributable to us.

Nothing in these Terms limits rights or remedies that cannot legally be waived.
12. DAMAGED, DEFECTIVE OR INCORRECT ITEMS
If you receive an item that appears damaged, defective, or incorrect due to an error on our part, please contact us promptly at:

Unless otherwise stated, the content associated with Jophiel Co. & The Modern Rancher—including original branding, logos, graphics, photographs, product photography, website content, original designs, text, and other original creative materials—is owned by or licensed to us and is protected by applicable intellectual property laws.
You may not reproduce, copy, distribute, sell, modify, commercially exploit, or use our protected content without authorization, except as permitted by applicable law.
Nothing in these Terms grants you ownership of our intellectual property.
Third-party trademarks, names, designs, or other intellectual property appearing on products or services remain the property of their respective owners.
14. CUSTOMER-SUBMITTED CUSTOM CONTENT
When submitting names, text, images, logos, artwork, photographs, graphics, or other materials for customization, you represent that you have the necessary rights or permission to use and submit those materials for the requested purpose.
You agree not to submit content that unlawfully infringes another person’s copyright, trademark, privacy, publicity, or other legal rights.
You grant us a limited right to use the submitted material solely as reasonably necessary to review, produce, fulfill, and provide your requested customized product or service.
We reserve the right to decline customization requests that we reasonably believe may violate applicable law, infringe third-party rights, or otherwise be inappropriate for production.
15. REVIEWS, PHOTOS & CUSTOMER CONTENT
If you voluntarily submit a review, testimonial, photograph, social media content, or other material to us, your submission remains subject to applicable law and any permissions you provide.
We will not claim unrestricted ownership of your personal photographs merely because you purchased from us or tagged our brand.
If we wish to use customer-created photographs or content for advertising or promotional purposes beyond permissions already provided through the applicable platform or submission process, we may request appropriate permission when required.
16. PROHIBITED USES
You may not use our website or services to:
• Violate applicable laws or regulations
• Infringe intellectual property rights
• Submit false, misleading, fraudulent, or malicious information

20. PROMOTIONS & DISCOUNT CODES
Promotions, discount codes, special offers, and sales may be subject to additional terms, eligibility requirements, expiration dates, exclusions, or quantity limits.
Unless otherwise stated:
• Discount codes cannot be combined with other offers.
• Discounts have no cash value.
• Discounts generally cannot be applied retroactively to completed purchases.
• Promotions may be modified or discontinued before an order is placed, subject to applicable law.

21. GIFT CARDS & STORE CREDIT
Gift cards and store credit are subject to any terms disclosed at issuance and applicable law.
Store credit issued for an approved return may be used toward eligible future purchases from our store.
Gift cards and store credit are not redeemable for cash except where required by applicable law.
Expiration or other restrictions, if any, will be applied only as permitted by applicable law.
22. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, our website and services are provided on an “as available” basis, except for any warranties or guarantees that cannot legally be excluded.
We do not warrant that website access will always be uninterrupted or error-free.
